Fun Size Moments Quarterly Prank Competition Terms & Conditions

1. Promoter

The Fun Size Moments Quarterly Prank Competition ("Competition") is conducted by Fun Size Moments ("Promoter").

2. Competition Period

Entries may be submitted throughout the year.

Submissions received during each calendar quarter will be reviewed during the first month following the end of that quarter.

The Promoter reserves the right to amend review dates where reasonably necessary.

3. Eligibility

Entry is open to Australian residents aged 18 years or older.

Employees, contractors, immediate family members and associates of the Promoter may enter but are not eligible to win prizes.

By entering the Competition, entrants warrant that they have the legal right to submit the content and agree to these Terms and Conditions.

4. How to Enter

To enter the Competition, participants must:

1. Upload a prank video through the official Fun Size Moments submission page.
2. Ensure the official Fun Size Moments competition card is clearly visible within the video for a minimum of three (3) seconds.
3. Provide all required submission information.

Entries that do not clearly display the official competition card may be deemed invalid and excluded from judging.

Multiple entries are permitted.

5. Content Requirements

Submitted videos must:

• Be original content created or lawfully submitted by the entrant.
• Not infringe any copyright, trademark, privacy or other legal rights.
• Not contain unlawful, offensive, abusive, defamatory, discriminatory or inappropriate material.
• Not depict dangerous, reckless or illegal behaviour.
• Not involve physical harm, threats, harassment, property damage or conduct likely to cause injury or distress.
• Not contain copyrighted music, audio, video, images or other intellectual property unless the entrant has obtained all necessary licences, permissions or authorisations.
• Comply with all applicable laws and regulations.

The Promoter reserves the right to reject, remove or disqualify any submission at its sole discretion.

6. Judging

This Competition is a game of skill.

Chance plays no part in determining the winner.

Eligible entries will be judged by a panel appointed by the Promoter based on criteria including:

• Creativity
• Originality
• Entertainment value
• Audience appeal
• Overall execution

The judging panel's decision is final and no correspondence will be entered into.

7. Prize

One winner will be selected each quarter.

The winning entrant will receive one (1) prepaid gift card with a value of AUD $250.

The gift card is not transferable, exchangeable or redeemable for cash except where required by law.

The Promoter reserves the right to substitute the prize with a prize of equal or greater value if necessary.

If a winner cannot be contacted within fourteen (14) days of notification, the Promoter reserves the right to select an alternative winner.

8. Grant of Rights

By submitting a video, the entrant grants Fun Size Moments a perpetual, worldwide, royalty-free, irrevocable, transferable and sublicensable licence to use, reproduce, publish, distribute, edit, adapt, modify and commercially exploit the submission in any media or format.

This licence includes the right to:

• Use, reproduce, edit, modify and adapt the submission.
• Publish and distribute the submission.
• Display the submission on websites, social media platforms and video-sharing platforms.
• Use the submission in organic and paid advertising campaigns.
• Create excerpts, edited versions, screenshots and promotional materials derived from the submission.
• Use the submission for marketing, promotional and commercial purposes.
• Authorise third parties acting on behalf of Fun Size Moments to use the submission for the purposes outlined in these Terms and Conditions.

Entrants acknowledge that they will not receive any compensation, royalties or additional payment for the use of submitted content other than any prize awarded through the Competition.

The Promoter may edit, crop, resize, caption, subtitle, dub, remix, adapt, reformat or otherwise modify submitted content for promotional, advertising, marketing or commercial purposes.

The entrant acknowledges that submitted content may be used in whole or in part and may be combined with other content.

The Promoter may use editing software, automation tools and artificial intelligence technologies to enhance, adapt, repurpose, caption, translate or otherwise modify submitted content for marketing, promotional and commercial purposes.

The licence granted to the Promoter under these Terms and Conditions continues indefinitely and remains effective regardless of whether:

• The entrant wins a prize.
• The entrant's submission is selected for publication.
• The Competition is discontinued.

The Promoter may use submitted content in perpetuity without further notice, approval or compensation to the entrant or any person appearing in the submission. The Promoter may use the content for commercial, promotional, advertising, marketing, editorial or other lawful purposes across any media now known or developed in the future.

9. Ownership and Rights Warranty

By submitting a video, the entrant warrants that:

• They are the creator of the submitted content or have obtained all necessary rights and permissions to submit it.
• The submission does not infringe the intellectual property rights, privacy rights or other legal rights of any person or entity.
• They have obtained all necessary permissions, consents and releases required under these Terms and Conditions.

10. Consent of Individuals Appearing in Videos

Entrants warrant that all identifiable persons appearing in a submitted video have consented to:

• Being recorded.
• The submission of the video to the Competition.
• The publication and commercial use of the video by Fun Size Moments.

Where a person under 18 years of age appears in a video, the entrant must obtain the consent of that person's parent or legal guardian.

The Promoter may request evidence of such consent at any time.

Entrants are solely responsible for obtaining all necessary permissions and releases.

11. No Guarantee of Publication

Submission of a video does not guarantee that the content will be published, promoted, featured, used in advertising or selected as a winning entry.

The Promoter may choose whether or not to use any submitted content at its sole discretion.

12. Winner Announcement

Winners may be announced on the Fun Size Moments website, social media channels and other marketing platforms.

By entering, participants consent to the publication of their name, social media handle, location and winning submission for promotional purposes.

13. Disqualification

The Promoter reserves the right to reject, remove or disqualify any entrant or submission that:

• Breaches these Terms and Conditions.
• Contains unlawful, misleading, defamatory, offensive or inappropriate content.
• Infringes the rights of any third party.
• May damage the reputation, goodwill or interests of Fun Size Moments.

14. Liability

To the maximum extent permitted by law, the Promoter is not responsible for:

• Lost, delayed, incomplete, corrupted or misdirected submissions.
• Technical malfunctions, interruptions or failures.
• Any injury, loss, damage or expense arising from participation in the Competition or acceptance of a prize.

Nothing in these Terms and Conditions excludes any rights or remedies that cannot be excluded under Australian Consumer Law.

15. Indemnity

To the maximum extent permitted by law, entrants agree to indemnify and hold harmless Fun Size Moments, its owners, employees, contractors and representatives from and against any claims, actions, losses, damages, liabilities, costs and expenses (including reasonable legal costs) arising from:

• The entrant's breach of these Terms and Conditions.
• Any infringement of intellectual property rights, privacy rights or other legal rights by the entrant's submission.
• Any false, misleading or inaccurate representation made by the entrant in connection with their submission.
• Any claim made by a third party arising from the entrant's submission or participation in the Competition.

16. Privacy

Personal information collected during the Competition will be used for:

• Administering the Competition.
• Contacting entrants regarding their submission.
• Awarding prizes.
• Marketing and promotional activities related to Fun Size Moments.

Entrants may opt out of marketing communications at any time.

17. Changes and Cancellation

The Promoter reserves the right to modify, suspend or cancel the Competition at any time where reasonably necessary.

Any material changes will be published on the Fun Size Moments website.

18. Acceptance

By submitting a video, entrants acknowledge that they have read, understood and agree to be bound by these Terms and Conditions.
